Welcome to Skill Elevate (“we,” “our,” “us”). By accessing or using our website (skillelevate.com.au) and services, you agree to comply with these Terms of Service (“Terms”). If you do not agree with these Terms, you may not use our services.

Terms of Service for Skill Elevate

1. Acceptance of Terms

By accessing and using this website (“Website”), you accept these Terms of Service (“Terms”). You also accept these Terms by clicking “accept” or “agree” where this option is provided.

Remaining on the Website indicates acceptance of its use of cookies for a better user experience. Cookies store session IDs for security and provide aggregate, non-personal information for site usage analysis.

2. Definitions

2.1. “Application” refers to a submission prepared by Skill Elevate containing documentation and information provided by you for an RTO.

2.2. “Application Date” is the date on which you pay the deposit or service fee to Skill Elevate.

2.3. “Application Period” refers to the 24-week period starting from the Application Date.

2.4. “Assessment” denotes the process of confirming competence against a unit of competency from an AQF qualification.

2.5. “Candidate” means an individual seeking to undergo a skills assessment.

2.6. “Customer” refers to an individual initiating an application with Skill Elevate.

2.7. “Extension Period” denotes an additional four weeks after the Application Period. Approval requires a $200 fee and is subject to Skill Elevate’s discretion.

2.8. “Partner” indicates an RTO collaborating with Skill Elevate to complete the RPL process and issue certifications.

2.9. “Personal Information” includes data identifying an individual.

2.10. “Qualification” refers to nationally recognized certification issued by a Partner RTO.

2.11. “Recognition of Prior Learning (RPL)” is the methodology to assess competence against predefined criteria.

2.12. “Refund Period” refers to the 4-week period starting from the Application Date.

2.13. “RTO” stands for Registered Training Organisation.

2.14. “Services Fee” is the fee you pay to Skill Elevate for their services.

2.15. “Services” include assistance provided by Skill Elevate to collect and organize materials for skills assessment.

2.16. “Skill Screening” refers to evaluating a customer’s readiness for the RPL process.

3. About the Website

3.1. The Website is operated by Skill Elevate. By browsing or using our Website or services, you confirm you have read and agree to these Terms. If you disagree, please cease usage immediately.

3.2. Skill Elevate reserves the right to revise these Terms at any time. Updates are effective immediately upon posting. Reasonable efforts will be made to inform you of significant updates.

4. Registration for Services

4.1. To access services, register online or contact Skill Elevate directly.

4.2. As part of the registration process, you must provide accurate personal information, including:

  • Full name
  • Email address
  • Mailing address
  • Phone number

4.3. You cannot use the services if you are under 18 or prohibited by applicable laws.

5. User Obligations

Users agree to:

  • Use services per applicable laws and guidelines.
  • Maintain the confidentiality of login credentials.
  • Notify Skill Elevate of any unauthorized account access.
  • Avoid commercial, illegal, or unauthorized use of the Website and services.
  • Refrain from automated interactions with the Website.

6. Payment Terms

6.1. The full Services Fee is due before submission of your application to an RTO.

6.2. Accepted payment methods include electronic funds transfer (EFT), credit card, or PayPal.

6.3. Skill Elevate is not responsible for fees or declined payments.

6.4. All payments are final once the RPL process has commenced unless otherwise stated in these Terms or required by law.

7. Refund Policy

7.1. Refunds are available under limited conditions, including:

  • You provide written notice within the designated Refund Period and before your application is submitted to the RTO.
  • The RTO determines that you are not eligible for a qualification, or if the qualification cannot be awarded due to issues such as invalid documentation or other exceptional circumstances beyond our control.
  • A refund is required under Australian Consumer Law.

7.2. Deposits or fees are non-refundable outside these conditions.

7.3. Refund requests must be submitted to [email protected] using the appropriate form.

8. Extension Policy

8.1. Extensions to the Application Period require a $200 fee and Skill Elevate’s approval.

9. Intellectual Property

9.1. Website content and related materials are protected under copyright laws. You may use materials only for personal, non-commercial purposes.

9.2. Unauthorized use, reproduction, or distribution of website materials is prohibited.

10. Privacy

10.1. Skill Elevate respects your privacy and handles data in accordance with its Privacy Policy. Personal data collected may be shared with third-party service providers as needed.

10.2. Security measures are in place to protect your data; however, Skill Elevate cannot guarantee absolute security due to inherent internet risks.

11. Limitation of Liability

11.1. Skill Elevate is not liable for indirect, incidental, or consequential damages resulting from your use of the Website or services.

11.2. Liability is limited to the resupply of services or refund of fees paid, as determined by Skill Elevate.

12. Termination

12.1. Either party may terminate these Terms with notice. Skill Elevate may suspend services for breach of these Terms or applicable laws.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Disputes are subject to Victorian courts’ jurisdiction.

IMPORTANT: Skill Elevate is not a Registered Training Organisation (RTO). We are an education support service provider assisting individuals with Recognition of Prior Learning (RPL) application preparation, documentation, and coordination. All qualifications are issued by our partnered RTOs.
